1. About these terms
This website, worldpolo.sg, and the store, products and services offered through it (together, the "Services") are operated by Travel Supplies Pte Ltd, trading as World Polo ("World Polo", "we", "us").
By accessing or using the Services, you accept these Terms of Service in their entirety. If you do not agree to these terms, please do not use the Services. By using the Services, you confirm that you are at least the age of majority in your place of residence, or that you are using the Services under the supervision of a parent or guardian.
2. Our policies
The following policies form part of these Terms of Service and are incorporated by reference:
- Our Privacy Policy (worldpolo.sg/policies/privacy-policy), which governs how we collect, use and disclose your personal information. If there is a conflict between these Terms of Service and the Privacy Policy, the Privacy Policy controls with respect to personal information.
- Our Refund Policy (worldpolo.sg/policies/refund-policy), which governs returns, exchanges and refunds.
- Our Warranty terms (worldpolo.sg/pages/warranty), which govern warranty coverage, claims and repairs.
3. Products, pricing and product information
We make every effort to display our products and their specifications as accurately as possible. However, we cannot guarantee that your device's display of any colour will be accurate.
All prices are in Singapore dollars (SGD) unless stated otherwise. Prices and product availability may change at any time without notice. We may limit the quantities of any product available for purchase.
Occasionally there may be information on the Services that contains typographical errors, inaccuracies or omissions, including in product descriptions, pricing, promotions and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate, at any time without prior notice — including after you have submitted your order. If we cancel your order for this reason, we will notify you and refund any amount you have paid in full.
4. Orders and payment
Your order is an offer to purchase. We accept your order when we confirm it or dispatch the products, whichever comes first. We reserve the right to refuse or cancel any order, including where we suspect fraud or unauthorised activity, where a pricing or listing error has occurred, or where stock is unavailable. If we refuse or cancel a paid order, we will refund the amount paid in full.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store, and to promptly update your account and other information, including your email address and payment details, so that we can complete your transactions and contact you as needed.
5. Delivery
Delivery timings shown on the Services are estimates and, while we work to meet them, they are not guaranteed. Risk in the products passes to you on delivery. If your order arrives defective, damaged or incorrect, our Refund Policy applies.
6. Website content
All information, data, text, photographs, graphics, audio, video and other material appearing on the Services ("Content") is owned by Travel Supplies Pte Ltd or its licensors and is protected by copyright and other intellectual property laws.
You may display, download and print Content for personal, non-commercial use only, provided you make no modifications to it and retain all copyright and proprietary notices. Any other use of the Content — including reproduction, distribution, republication, transmission, mirroring of any material on any other server, or use for resale purposes — requires our prior written permission.
The permission granted above terminates automatically if you breach any of these terms; upon termination you agree to immediately destroy any downloaded or printed Content. Unauthorised use of Content may violate copyright and other laws.
7. Trademarks
Brand names and marks used on the Services, including World Polo, are trademarks of Union Leather Goods Co., Travel Supplies Pte Ltd, or their respective holders. You may not use or reproduce any such trademark without the holder's permission.
8. Reviews, comments and submissions
All comments, feedback, reviews, suggestions, ideas, proposals and other submissions disclosed, submitted or provided to us through the Services (collectively, "Comments") shall be and remain our property. Providing Comments constitutes an assignment to us of all worldwide rights, titles and interests in all copyrights and other intellectual property in the Comments, and we shall not be limited in any way in our use, commercial or otherwise, of any Comments. We are under no obligation to maintain any Comments in confidence, to compensate you for any Comments, or to respond to any Comments.
We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or in violation of any party's intellectual property or these Terms of Service.
You agree that your Comments will not violate any right of any third party, including copyright, trademark, privacy, personality or other personal or proprietary rights, and will not contain libelous or otherwise unlawful, abusive or obscene material, or any computer virus or other malware. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any Comments. You are solely responsible for any Comments you make and their accuracy. We take no responsibility and assume no liability for Comments posted by you or any third party.
9. Accounts and passwords
If your use of the Services requires a password, you agree to keep it secure and not to share it with anyone. You are responsible for all activity conducted with your password if you share it or fail to take reasonable steps to keep it secure.
10. Availability of the Services
Access to the Services is permitted on a temporary basis. We may withdraw, amend or restrict access to some or all of the Services at any time without notice, and we will not be liable if the Services are unavailable at any time or for any period.
11. Disclaimer and limitation of liability
To the maximum extent permitted by law, the Services and all Content are provided "as is" and "as available", without warranties of any kind beyond those expressly stated in our Warranty terms and those implied by law that cannot be excluded.
Nothing in these Terms of Service excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under Singapore law.
Subject to the paragraph above and to the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special or consequential loss (including loss of revenue, profits, business, use, goodwill or data) arising from your use of the Services, and our total aggregate liability to you in connection with any order shall not exceed the amount you paid for that order.
12. Your consumer rights
Nothing in these Terms of Service limits or excludes your rights under Singapore consumer protection law, including the Consumer Protection (Fair Trading) Act and the Sale of Goods Act.
13. Indemnity
You agree to indemnify us against claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms of Service or your misuse of the Services, to the extent such indemnity is enforceable under applicable law.
14. Changes to these terms
You can review the most current version of these Terms of Service at any time on this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the Services following the posting of any changes constitutes acceptance of those changes.
15. General
If any provision of these Terms of Service is held to be unlawful, void or unenforceable, that provision shall be enforceable to the fullest extent permitted by law, and the remaining provisions remain in full force. Our failure to enforce any right or provision is not a waiver of it. These Terms of Service, together with the policies incorporated in section 2, constitute the entire agreement between you and us regarding the use of the Services.
16. Governing law
These Terms of Service and any separate agreements whereby we provide you Services are governed by the laws of Singapore, and you submit to the non-exclusive jurisdiction of the Singapore courts.
